PBA Spring Membership Recruitment Contest

Official Rules

The PBA Spring Membership Recruitment Contest (“Contest”) will begin on January 1, 2023 at 12:01 A.M. ET and ends on June 30, 2023 at 11:59 P.M. ET (“Contest Period”). All times in the Contest refer to Eastern Time (“ET”). The Contest is NOT a game of chance. It is a competition among members of the Pennsylvania Builders Association and governed solely by the rules of the Contest. In the event of any dispute, all challenges or questions shall be decided by the Senior Officers of PBA in consultation with the PBA CEO and PBA legal and accounting advisors, as applicable. The Contest is subject to all applicable federal, state, and local laws.

ELIGIBILITY: Open only to Builder, Associate, and Affiliate members of the Pennsylvania Builders Association who are (i), documented members in good standing during the period of January 1, 2023 through June 30, 2023, (ii), and who are eighteen (18) years of age or older as of the start of the Contest Period and (iii) able and willing to enter into a legally binding lease agreement governing use of the first prize beach house. Notwithstanding their respective membership status, Senior Officers and employees of Pennsylvania Builders Association as well as employees of affiliated local builders’ associations and each of their respective spouses, and/or persons living in the same households as these persons (whether or not related thereto) are not eligible for Contest Prizes.

WINNER SELECTION AND NOTIFICATION: On or about July 17, 2023, one (1) potential grand prize winner (“Grand Prize Winner”) will be selected based on the number of new PBA Builder and Associate members recruited during the Contest period as reported in the NAHB WMS membership database. PBA will make two (2) attempts to notify the potential Grand Prize Winner at the email address recorded in the NAHB WMS database. Potential Grand Prize Winner may be required to execute and return an affidavit of eligibility, release of liability, and, except where prohibited, publicity release (collectively, “Contest Documents”) within seven (7) business days of such notification. Noncompliance within this time period will result in disqualification, and, at PBA’s sole discretion an alternate potential Grand Prize Winner may be selected based on total spike credits earned for Builder and Associate Members during the Contest Period as reported in NAHB’s WMS. If a potential Grand Prize Winner cannot be reached, is found to be ineligible, cannot or does not comply with these Official Rules, or if the Grand Prize (as defined below) or prize notification is returned as undeliverable, such potential Grand Prize Winner will be disqualified and time permitting, at PBA’s sole discretion, an alternate potential Grand Prize Winner may be selected from the remaining eligible Entries.

Prize winners’ names, photographic likenesses and local association affiliations will be publicized through PBA media including the PBA web site, PBA social media and at in-person PBA events. Prize winners may be asked to sign an affidavit permitting such use.

Instant Winner and Grand Prize Winner may be referred to “Winner” or “Winners”.

GRAND PRIZE: There will be one (1) grand prize (“Grand Prize”) awarded to the Grand Prize Winner. Grand Prize will consist of a one-week use of a beach house located at 22 Tenth Street Beach Haven NJ 08904. Trip includes full access and use of the aforementioned beach house subject to the rules and lease agreement for the house. Grand Prize Winner will also receive a gift card with a stated value of two hundred and fifty dollar ($250.00).

PBA will award a second prize consisting of one gift card with a stated value of two hundred and fifty dollars ($250.00).

All prizes will be awarded on a strictly “as is” basis with no warranty or guaranty either express or implied by PBA or the owner of the Prize beach house.

Estimated Retail Value (“ERV”) of Grand Prize is three thousand dollars ($3,000.00). Actual Retail Value (“ARV”) of Prize may vary. Any difference between ERV and ARV will not be awarded. For any Prize with an ARV of six hundred dollars ($600) or greater, PBA will furnish an Internal Revenue Service Form 1099 to Grand Prize Winner for the ARV of Prize for the year in which Prize was won. Prize winners are solely responsible for any tax consequences of accepting any prize pursuant to this Contest.

All details of Grand Prize will be determined by PBA in its sole discretion. Grand Prize Winner must be able to travel and complete usage of the Prize beach house between September 16, 2023 and September 30, 2023. Usage of the Prize beach house awarded to the Grand Prize Winner must be taken within dates provided in this document or the Prize will be forfeited. Grand Prize Winner must execute a Short Term Lease agreement with the beach house owner and comply with all terms of the Lease including a fully-refundable security deposit. Grand Prize is non-transferable.

PBA expressly disclaims any warranty or guaranty regarding the use of the Prize beach house. Disputes regarding the Grand Prize Winner’s actual use or occupancy of the beach house must be appealed to the owner of the beach house and will be subject to the terms of the Short Term Lease Agreement for use of the house.
